DEBT COLLECTION HARASSMENT
Who Is a Debt Collector?Under the federal Fair Debt Collection Practices Act (FDCPA), a debt collector is someone, other than a creditor, who regularly collects debts for others. This federal law does not cover creditors, although your state laws in many cases may govern them. Thus, a retailer who attempts to collect unpaid debts owed to it would not be covered by the FDCPA, but may be covered by the laws of the state where the delinquent consumer resides. These laws usually are similar to the federal Fair Debt Collection Practices Act. - Debt Collectors who are abusive and harassing may be sued.
- Debt Collectors who have no right to collect the debt may be sued.
- Debt Collectors are required to follow strict rules when collecting consumer debts; they cannot threaten legal action when they do not intend to, they cannot threaten criminal action either.
If you are being harassed by debt collectors, please contact The Law Office of Shmuel Klein, PC right away. You may be entitled to a money and the debt being wiped out.
